A POET and organic gardener, who had claimed he could not be evicted

from his makeshift home on a Perthshire small holding because it stands

on a sacred Celtic site, has had his appeal against the eviction

rejected.

Yesterday, in a written judgment, Sheriff-Principal John Maguire says

Rodney ''Magi'' McGlynn, 39, one of the last remaining members of a

hippy camp at Auchtubh, Balquhidder, seemed to live in a parallel world.

The sheriff-principal adds he that had done nothing to persuade him

that Sheriff Frederick Levine had erred in his original ruling that he

must leave his ''bender'', made from stones and branches, after being

asked to go by landowner, Mr Albert Sauer.

Sheriff-Principal Maguire, who heard the appeal at Stirling Sheriff

Court earlier this month, says Mr McGlynn had failed to direct himself

to the task of attacking the sheriff's judgment. After alleging that the

court was corrupt, Mr McGlynn had launched into what the

sheriff-principal described as an interesting, if xenophobic, address.

The ruling means sheriff officers can move to eject Mr McGlynn, unless

he lodges notice of appeal to the Court of Session by August 24.
